The subject matter of commercial disputes can arise from virtually any form of commercial activity.  Often a key issue will be the terms of a contract between the parties to the dispute.  Property, whether tangible assets or other legal rights, may be involved and claims for damages or other legal remedy may be substantial.

Parties contemplating commercial litigation need to carefully weigh up a number of factors before taking the decision as to how to proceed.  These factors include the merits of the case, the evidence available, the relative financial positions of the parties, the likely costs of the case and the impact of commercial litigation on the business and reputation of those concerned.  Sensitive and commercially aware legal advice is essential to making the right assessment.  

Routes to resolution

Commercial litigation proceedings may be brought in the one of the specialist divisions of the High Court, or in some cases, in the County Court.  The parties may be bound to follow some agreed dispute resolution procedure such as arbitration or mediation or they be advised to do so.  Sometimes urgent action is required which may lead to an injunction application. Careful preparation of the case and consideration of the right strategy, whether it is for hearing by a court or for commercial negotiations, is always a vital element is achieving the right outcome.
